It happened near Paignton Pier in the early hours of Saturday (26th October)
Police have confirmed a 29 year old man from Brixham's died after being pulled from the water.
Emergency services were called in the early hours of Saturday morning to reports that a man had entered the sea near Paignton Pier.
He was located in the water between Preston Sands and Hollacombe Beach, but despite receiving CPR he died later at Torbay Hospital.
His death is not being treated as suspicious, but police say enquiries are ongoing.
