The Highways agency has given a family, living illegally on land near Exminster, notice to quit.
A fence was broken down and five caravans driven on to the land some time ago.
The agency said they had to delay taking action while a full and proper investigation was carried out.
It's believed that the family comes from Exeter and was made homeless recently.
