A motorist is to appear in court in connection with the death of a road worker from Tiverton.
Steven Tolley, who was 48, died of his injuries after an accident on the A361 in January 2013.
He was working on the carriageway near Gornhay Cross along with two other men who were less seriously hurt.
The 44-year-old driver of the van involved, who comes from East Cornwall, has been reported for causing Mr Tolley's death by dangerous driving.
He will appear at Exeter Magistrates Court at a date yet to be set.
