The family of the Exeter man Thomas Orchard, who died after being arrested and restrained by police in the city, say they're dismayed that the force will not be prosecuted for corporate manslaughter.
Devon and Cornwall Police have been charged with breaking health and safety regulations in relation to his death.
An initial hearing will take place at Westminster Magistrates Court next month.
His parents are disappointed that the more serious charge will not be pursued, but say they are glad that the force will now need to account for their actions.
